Terms of Service
The terms and conditions that govern your use of BARCODE AI Agents and our AI automation platform.

1. Acceptance of Terms
By accessing or using the BARCODE AI Agents platform ("the Service") provided by BARCODE ("we", "us" or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms apply to all visitors, users and customers of the Service.
2. Our Services
BARCODE provides AI automation solutions for Australian local businesses, including AI receptionist, AI website and chatbot, AI reviews and reputation management, AI lead follow-up and reactivation, email and SMS campaigns, and paid advertising on social media. We act as a service provider that helps automate customer communication, lead capture, appointment booking, follow-up and reputation management. We reserve the right to modify, suspend or discontinue any feature of the Service at any time.
3. Your Account & Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information when booking an audit or engaging our services, and to use the Service in compliance with all applicable Australian laws and regulations. You are responsible for the content of any customer communications, scripts, prompts or configurations used within the AI platform.
4. Acceptable Use
You agree not to use the Service to:
- Send unsolicited or spam communications in breach of the Spam Act 2003 (Cth).
- Violate the privacy or rights of any third party.
- Transmit any material that is unlawful, misleading, defamatory or otherwise objectionable.
- Attempt to gain unauthorised access to the Service or its systems.
- Resell or redistribute the Service without our written consent.
5. Intellectual Property
All content, software, branding, designs, AI models and materials provided by BARCODE remain our intellectual property. You retain ownership of your business name, customer data and any content you supply to the platform. You grant us a licence to use your supplied content solely for the purpose of delivering the Service to you.
6. Customer Data & Privacy
We handle your information and your customers' information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). You are responsible for obtaining any necessary consents from your customers before their details are captured, stored or contacted through the Service.
7. Fees, Billing & Cancellation
Fees for the Service are set out in your proposal or service agreement. Unless otherwise agreed, fees are billed in advance on a monthly basis. You may cancel your subscription by providing written notice in accordance with your service agreement. Setup fees and amounts already paid for the current billing period are generally non-refundable unless required by Australian consumer law.
8. Limitation of Liability
To the maximum extent permitted by law, BARCODE is not liable for any indirect, incidental or consequential damages arising from your use of the Service. AI technology may occasionally produce unexpected or inaccurate outputs, and the Service is provided on an "as is" basis. Our total liability for any claim is limited to the amount you have paid us in the three months preceding the claim. Nothing in these Terms excludes or limits any rights or remedies that cannot be excluded under Australian consumer law.
9. Service Availability
While we strive for high availability, we do not guarantee that the Service will be uninterrupted or error-free. Maintenance, updates and factors outside our control (including third-party telephony, SMS and email providers) may affect performance. We are not liable for outages caused by third-party services.
10. Third-Party Services
The Service may integrate with third-party tools such as telephony providers, calendar systems, SMS and email gateways and advertising platforms. We are not responsible for the availability, accuracy or conduct of these third-party services, and their terms may also apply to you.
11. Termination
We may suspend or terminate your access to the Service if you breach these Terms. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination — including intellectual property, liability and governing law — will remain in effect.
12. Governing Law
These Terms are governed by the laws of Australia. Any dispute arising out of or in connection with these Terms will be resolved in the courts of Australia, and you submit to the exclusive jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes where reasonably practicable. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
